Detailed Introduction
① Basic Overview and Structure:
After 2024, the former Ministry of Environment and Forestry (KLHK) was split, and environmental supervision responsibilities were transferred to the Ministry of Environment / Environmental Control Agency. This agency is responsible for environmental impact assessment, pollution control, environmental approvals, hazardous waste, corporate environmental reports, environmental enforcement, and ecological compliance. It is a key regulatory body for industrial project commencement and operation.
② Role and Operation:
The Ministry of Environment / BPLH manages AMDAL, UKL-UPL, environmental approvals, effluent discharge, B3 hazardous waste, environmental monitoring, and enforcement inspections. Projects generally need to determine the environmental assessment pathway based on scale, risk, and industry type, then coordinate with regional approvals via OSS, AMDALNET, or relevant environmental systems. After production begins, companies must continue environmental reporting, emission control, and waste management.
③ Relevance and Use for Chinese Enterprises:
For Chinese enterprises in mining, smelting, chemicals, industrial estates, power plants, cement, pulp and paper, battery materials, building materials, and large-scale manufacturing, environmental approval is a prerequisite for project commencement and operation. Before land acquisition and construction, companies should confirm environmental assessment responsibilities, emission quotas, waste treatment, surrounding community impact, and local environmental requirements. Otherwise, they may face shutdowns, fines, protests, or permit delays.
